A 10-year-old 3rd-grade student at Argyle Elementary School in Orange Park was arrested on Friday, May 23rd, after school staff discovered he was in possession of an operational electric stun gun on school grounds.

The Clay County Sheriff’s Office (CCSO) responded after another student reported that the male student might have a weapon. The stun gun was seized as evidence, and a criminal investigation was conducted, including interviews with the reporting student and school staff.

The CCSO stated that no students were harmed as a result of this incident.

The juvenile was arrested and charged with Florida State Statute 790.115(2)(A), “Possessing or discharging weapons or firearms at a school-sponsored event or on school property prohibited,” which is a third-degree felony. He was subsequently transferred to the Department of Juvenile Justice – Duval Detention Center.

Florida Statute 790.115(2)(a) prohibits any person from possessing “any firearm, electric weapon or device, destructive device, or other weapon… at a school-sponsored event or on the property of any school, school bus, or school bus stop,” with limited exceptions not applicable in this case.
