Davenport Man Charged With 4 Felonies After Fighting Polk County Deputies

A 37-year-old Davenport man faces four felony and four misdemeanor charges after deputies said he threatened to kill family members, fought officers and turned out to be carrying a knife. The Polk County Sheriff’s Office said the confrontation happened Monday afternoon, October 26.

Deputies charged 37-year-old Maxwell James Murrain of Davenport with battery on a law enforcement officer, three counts of resisting with violence, three counts of resisting without violence and giving a false name to law enforcement.

The Sheriff’s Office said it received a report at about 1:30 p.m. that a Davenport man was threatening to kill family members. The caller also said he threatened “suicide by cop” if deputies showed up.

Fight on a neighborhood street

Deputies found the man walking in the Florida Pines neighborhood off US 27. They told him they needed to talk with him and wanted to pat him down for weapons first.

He refused and began backing away, the Sheriff’s Office said. He ignored multiple commands to cooperate, so deputies tried to detain him. When they put their hands on him, he started fighting them, according to the agency.

Deputies used a Taser to subdue him and then secured him.

Knife found, false name given

Deputies saw that the man was bleeding from a laceration on his arm. They then found he had a knife and disarmed him. Deputies took him to a hospital for treatment.

The Sheriff’s Office said the man gave deputies a false name during the investigation. Investigators eventually identified him as Murrain.

Deputies checked on Murrain’s family members and found they were all safe.

Charges

After his medical treatment, deputies took Murrain to the Sheriff’s Processing Center. The charges break down as follows:

  • Battery on a law enforcement officer, a third-degree felony
  • Resisting with violence, a third-degree felony, three counts
  • Resisting without violence, a first-degree misdemeanor, three counts
  • False ID to law enforcement, a first-degree misdemeanor

Charges are accusations, and Murrain has not been convicted of any crime.

The source did not say whether Murrain has an attorney or when his first court appearance is scheduled.
