The Live Oak Police Department (LOPD) arrested 45-year-old Kevin James Gary on April 3, 2025, following a complaint of lewd and lascivious sexual misconduct involving a minor child.
According to the LOPD, officers were dispatched to the complaint when Suwannee County Sheriff’s Office dispatch relayed information that the incident had just occurred and the suspect was leaving the area on foot after realizing law enforcement had been contacted. The suspect, identified as Kevin James Gary of Live Oak, was known to the victim’s mother.
LOPD Sgt. Gerald Butler located Gary while en route to the call. Gary reportedly attempted to hide behind a tree and then resisted Sgt. Butler’s commands to stop. During the attempt to place him in handcuffs, Gary allegedly continued to struggle and refused to cooperate. He was also in possession of an open container of alcohol. Gary was apprehended and initially taken into custody for Resisting/Obstruction of a law enforcement officer. During this time, Gary allegedly spontaneously stated that he had kissed the minor child.
Investigator Jeramie Cheshire conducted interviews with the 15-year-old victim, the victim’s mother, and a third witness. Sworn statements reportedly indicated that Gary allegedly exposed his sexual organ to the minor, solicited the child to engage in sexual intercourse, and touched, groped, and kissed the victim while attempting to solicit sexual conduct.
The child and mother were turned over to Child Protective Team Services for further investigation and evidence collection.
Kevin James Gary was arrested and charged with Resisting/Obstructing a Law Enforcement Officer, Lewd and Lascivious Conduct by Exposure of Sexual Organs to a Minor Child, and Lewd and Lascivious Conduct by Soliciting Minor Child to Engage in Sexual Activity. He was booked into the Suwannee County Jail and is awaiting criminal proceedings.
The names of the victim, other witnesses, and the specific location of the incident are being withheld to protect the victim’s identity and the integrity of the ongoing investigation.
