Volusia County Father Charged With Aggravated Manslaughter After Son Dies More Than Three Years After Alleged Abuse

VOLUSIA COUNTY, Fla. — A Volusia County man has been charged with aggravated manslaughter after his young son died more than three years after suffering catastrophic injuries investigators say were caused by physical abuse.

According to the Volusia Sheriff’s Office, Malcolm Nelson is now charged with Aggravated Manslaughter in the death of his son, Noah Nelson.

The case began in January 2023, when 3-month-old Noah was hospitalized with traumatic injuries. Doctors determined the infant had suffered multiple injuries and fractures consistent with physical abuse, including violent shaking.

Following an extensive investigation, Malcolm Nelson was arrested in October 2023 and charged with Aggravated Child Abuse.

Despite extensive medical treatment, Noah never recovered. He remained on life support for more than three years before being released to hospice care at home in April 2026. He died a few days later at the age of 3½.

Throughout that time, detectives with the Volusia Sheriff’s Office Major Case Unit remained in contact with the Medical Examiner’s Office and the Office of the State Attorney for Florida’s 7th Judicial Circuit while awaiting the outcome of Noah’s medical condition.

This week, the Medical Examiner’s Office issued its final report, ruling Noah’s death a homicide. The cause of death was determined to be complications of abusive head trauma.

Nelson had previously pleaded no contest to the aggravated child abuse charge and was sentenced to 180 days in jail, followed by two years of community control and 13 years of probation.

Earlier this week, Nelson was taken into custody at his probation office for violating the terms of his probation.

Following the release of the medical examiner’s report, detectives obtained a warrant charging Nelson with Aggravated Manslaughter. The warrant was served while he remained in custody at the Volusia County Branch Jail.

The investigation remains closed pending prosecution.
