Mossy Head Man Accused of Shooting Into Vehicle After Argument Over Revving Engine

WALTON COUNTY, Fla. – A 60-year-old Mossy Head man was arrested after deputies say an argument with a driver over a revving engine escalated into gunfire, leaving a bullet lodged in the driver’s side door of the victim’s vehicle.

Toby Burkett faces multiple felony charges following the shooting on Walters Road late Friday night, according to the Walton County Sheriff’s Office. The driver was not injured.

Deputies responding to a report of shots fired learned that the incident began after the victim revved his vehicle’s engine while in the roadway in front of Burkett’s home.

The victim told investigators a verbal argument followed. Deputies said Burkett then fired a gun toward the occupied vehicle.

Investigators found a bullet hole in the driver’s side door. The round did not penetrate completely through the door, and the driver escaped injury.

When deputies attempted to arrest Burkett, authorities said he resisted and deputies used a Taser to take him into custody. Burkett was transported to a hospital for evaluation and declined to speak with investigators.

Deputies later obtained a search warrant for Burkett’s home and vehicle.

The Walton County Sheriff’s Office Crime Scene Unit processed the scene, using a FARO scanner, a 3D reality-capture system that allows investigators to document and reconstruct a scene digitally.

During a search of Burkett’s truck, deputies reported finding a .22-caliber revolver-style handgun containing two spent cartridge casings. Investigators also recovered a .308-caliber rifle cartridge.

Burkett was booked into the Walton County Jail on charges of aggravated assault with a deadly weapon without intent to kill, shooting into an occupied vehicle, criminal mischief, obstruction, using a firearm during the commission of a felony and three counts of possession of a firearm by a convicted felon.

He remained in custody at the time the sheriff’s office announced the arrest.

The Walton County Sheriff’s Office said the investigation remains ongoing.
